OVERVIEW

Ladderjoy (ladderjoy.shop) is operated by FLIP BM MARKETING LLC. Throughout these Terms of Service, “Ladderjoy,” “we,” “us” and “our” refer to FLIP BM MARKETING LLC. “You” and “your” refer to the person accessing our website or purchasing from us.

These Terms govern your use of our website and purchases from our store. Please read them before placing an order. When you place an order, you agree to the terms and purchase conditions presented to you before you complete checkout.

Our website storefront is hosted on Lovable. Shopify provides our e-commerce backend, and checkout is hosted by Shopify. These providers supply technology services; FLIP BM MARKETING LLC remains responsible for our store, product offers, customer service and obligations to our customers.

Our Return and Refund Policy, Shipping Policy and Privacy Policy address their respective subjects. Applicable purchase policies must be made available before checkout.

Nothing in these Terms excludes, limits or overrides consumer rights or other protections that cannot legally be waived.

1. ELIGIBILITY AND PERMITTED USE

To place an order, you must have the legal capacity to enter into a binding agreement under the laws that apply to you. If you are under the applicable age of majority, a parent or legal guardian must place the order on your behalf.

You may use our website only for lawful purposes. You must not use it to commit fraud, infringe another person’s rights, distribute malicious software, or interfere with the website’s operation or security.

2. GUEST CHECKOUT AND CUSTOMER INFORMATION

Ladderjoy offers guest checkout. You do not need to create a Ladderjoy account or password to purchase from us.

If Shopify or a payment provider offers an optional sign-in, saved-payment or accelerated-checkout service, your use of that service is governed by the relevant provider’s terms and privacy notice. It does not require you to create a Ladderjoy account.

You must provide accurate and complete checkout information, including your name, contact details, billing details and delivery address.

If you notice an error in your order information, contact info@ladderjoy.shop promptly. We will explain whether a correction is still possible based on the order’s processing status. Changes cannot always be made after dispatch.

3. PRODUCTS AND PRODUCT INFORMATION

We aim to present accurate product descriptions, specifications, prices, availability and images.

Colors and appearance may vary slightly because of screen settings, lighting or photography. Such variations do not remove your rights if an item is defective, materially different from its description, or otherwise fails to meet applicable legal requirements.

Only the items, quantities, accessories and features expressly included in a product listing form part of that offer. Decorative props are not included unless stated.

Product-specific instructions, warnings and restrictions should be reviewed before purchase and use. Nothing in these Terms reduces our responsibility for accurate product descriptions or legally required safety information.

4. PRICES, TAXES AND PAYMENT

Prices are displayed in the currency identified on the website and at checkout.

Before you complete your purchase, checkout will display the order total, including applicable taxes, shipping charges and other charges collected by us.

Payment methods are those available in Shopify-hosted checkout when you place your order. Payments are subject to authorization and applicable fraud-prevention checks.

Placing an order authorizes the payment required for that order. Any recurring payment arrangement, if offered, must be separately and clearly disclosed and expressly accepted before purchase.

Future price changes do not alter the agreed price of an order we have already accepted.

We will not charge you an increased price to correct an error without your agreement. If a material pricing error prevents us from fulfilling an order at the stated price, we will contact you and either obtain your agreement to a revised offer or cancel the affected order and refund any payment collected for it, subject to applicable law.

5. ORDERS, CONFIRMATION AND CANCELLATION

After you place an order, we will send an order acknowledgment using the contact information provided at checkout.

Unless we expressly state that an acknowledgment constitutes acceptance, it confirms receipt of your order. We accept an order when we confirm that it has been dispatched, or when we expressly notify you of acceptance earlier.

We may decline or cancel an order for a legitimate reason, such as unavailable stock, inability to deliver to the requested destination, a material listing error, suspected fraud, failed payment authorization or a legal restriction. These rights are subject to applicable law.

If we cancel all or part of a paid order, we will notify you and refund the payment collected for the canceled items, including associated charges where required. We will not impose a cancellation fee for a cancellation initiated by us.

Contact us promptly if you wish to cancel or change an order. We will confirm whether the request can be accommodated. If the order has already been dispatched, the Return and Refund Policy and applicable consumer law will govern the available options.

6. SHIPPING AND DELIVERY

Available delivery destinations, shipping costs, processing times and estimated delivery times will be disclosed before purchase through the product page, Shipping Policy or checkout, as appropriate.

Processing time and shipping transit time are separate unless expressly stated otherwise. Delivery estimates are estimates unless we explicitly offer a guaranteed delivery date.

Products may be fulfilled by us or by third-party suppliers or fulfillment providers acting on our behalf. We remain your contact for order assistance and responsible for our obligations as the seller. Relevant shipping origins and any material cross-border delivery conditions will be disclosed accurately before purchase.

If we cannot ship within the promised timeframe, we will notify you and provide any legally required options to agree to a revised timeframe or cancel for a refund.

If your order is missing, damaged in transit or marked delivered but not received, contact us promptly so we can investigate and provide the remedy required by the circumstances and applicable law. Tracking information does not remove your consumer rights.

7. RETURNS, REFUNDS AND DEFECTIVE PRODUCTS

Our Return and Refund Policy explains eligibility, return time limits, product-condition requirements, return procedures, return shipping costs and refund processing.

The applicable return conditions will be made available before purchase. We will not apply newly introduced restrictions retroactively to an existing order.

If an item arrives damaged, is defective, is incorrect or materially differs from its description, contact info@ladderjoy.shop with your order details and a description of the problem. We may request reasonable supporting information to assess the issue.

We will provide the repair, replacement, refund or other remedy required by applicable law and the purchase terms. Nothing in our return policy limits rights that cannot legally be excluded.

Refunds will normally be issued to the original payment method unless another lawful method is agreed or the original method is unavailable. We will communicate the applicable processing timeframe. Your bank or payment provider may require additional time to display the refund.

8. PRODUCT WARRANTIES AND CONSUMER RIGHTS

Any express product warranty we offer will be described in the relevant product listing or warranty documentation and made available before purchase where required.

Any applicable manufacturer warranty will be identified accurately. We do not claim manufacturer authorization or warranty coverage unless it actually applies.

Nothing in these Terms excludes an express warranty, applicable implied warranty or mandatory consumer guarantee that cannot lawfully be excluded.

We aim to maintain a reliable and accurate website, but access may occasionally be interrupted by maintenance, technical faults or circumstances outside our reasonable control.

We may update website content, correct errors, or change or discontinue website features. These changes do not remove our obligations relating to existing orders.

If an error materially affects your order, we will contact you and address it under these Terms and applicable law rather than silently changing the agreed purchase conditions.

10. THIRD-PARTY SERVICES AND LINKS

Our website and checkout use third-party technology and may include links to external websites or optional services.

External services may have their own terms and privacy notices. Please review those notices when using the services.

We are not responsible for unrelated third-party websites that we do not operate or control. However, the involvement of Shopify, Lovable, payment providers, suppliers or fulfillment providers does not remove our responsibilities to you as the seller.

Our Privacy Policy explains how personal information is collected, used, shared and protected, and the choices and rights available to you.

Information necessary to process your purchase may be handled by Shopify, payment providers, hosting providers, delivery providers and other service providers according to their roles.

Shopify and the applicable payment provider process payment-related information to facilitate checkout, payment authorization, fraud prevention and other applicable legal obligations. Certain providers may process personal information independently under their own privacy notices.

Provide payment details only through the designated checkout. Do not email us your full card number, security code or account password.

These Terms do not replace our Privacy Policy or any consent required by applicable law.

12. REVIEWS, FEEDBACK AND SUBMISSIONS

If you submit a review or other content intended for public display, you grant us a non-exclusive, royalty-free permission to display, reproduce and reasonably format that content for our website and related product communications.

You retain ownership of your content. We will not knowingly alter a review to misrepresent your experience or use your content in a misleading way.

Private support messages, order information and personal information are not public submissions under this section. Their handling is governed by our Privacy Policy and applicable law.

We may remove content that violates these requirements. We will not suppress honest criticism merely because it is negative.

16. TERMINATION AND SUSPENSION

You may stop using the website at any time.

We may suspend or terminate access for a material breach of these Terms, unlawful activity or a genuine security risk.

Ending website access does not cancel our obligations concerning paid orders, refunds or other rights and liabilities that continue under applicable law.

17. GOVERNING LAW AND DISPUTES

These Terms and purchases from our store are subject to applicable United States federal law and the state law determined by the relevant jurisdiction’s applicable choice-of-law rules.

If mandatory consumer protections in your place of residence apply to your purchase, these Terms do not deprive you of those protections.

These Terms do not require mandatory arbitration or waive any rights that cannot lawfully be waived.

If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A failure to enforce a provision immediately does not waive the right to enforce it later.
